Privacy Notice for Website Visitors pursuant to Article 13 of Regulation (EU) 2016/679

Introduction

This notice - provided in accordance with the applicable legislation on the protection of personal data, with specific reference to Article 13 of Regulation (EU) 2016/679 (hereinafter also the “Regulation”) - aims to inform Users of the website www.bragamoro.com (hereinafter also the “Website”) about the processing of personal data arising from browsing the same or from filling in specific contact forms.

Data Controller

Braga Moro Sistemi di Energia S.p.A., hereinafter also “Braga Moro”, with registered office at Via Giovanni Marcora 36, Tax Code and VAT No. 07620910153, owner of the Website, acts as the Data Controller for the personal data of Users who browse the Website.

Users may contact the Controller by registered letter with return receipt to the Controller's registered office or by sending an e-mail message to privacy@bragamoro.com.

Source and nature of the personal data processed

The Website displays informational content regarding Braga Moro's activities.

Browsing the Website, or the User's interaction by completing the contact form, results in the Controller acquiring information as identified below:

  • Browsing data
    This type of data includes: IP addresses, the browser used, domain name and addresses of websites from which access was made, the addresses in URI (Uniform Resource Identifier) notation of the requested resources (typically the WEB pages of this website), the method used to query the server, the size of the file obtained in response, as well as other parameters relating to the user's operating system and IT environment, access time and time spent on each individual page visited. Such data are acquired solely in order to ensure the technical functioning of the Website. Their acquisition, through the IT systems responsible for the functioning of the Website, and the transmission of the above-mentioned data are implicit in the use of Internet network protocols (for any further information, please refer to the cookie policy available in the dedicated section of this Website).
  • Contact data
    If the User, by accessing the “Contacts” section, sends requests for information to the Controller, the latter will acquire the contact data voluntarily provided by the User (e.g. first name, last name, e-mail address) as well as the specific contents entered in the body of the message. Such data will be processed solely in order to handle the request and for the time strictly necessary for that purpose. Without prejudice to what is further prescribed below (see paragraph “Scope of communication of personal data”), in no case will the Controller make the User's personal data accessible to Third Parties, except for the parties in charge of the technical management of the website.

Purposes and legal basis of the Processing

The Controller processes personal data deriving from browsing the Website and those that the User voluntarily provides in connection with the use of the same.

In particular, the User's personal data are processed for the purposes indicated below and in accordance with the legal bases described herein:

  • Provision of the Website's services and features, as well as verification of their proper functioning and improvement of the browsing experience. The legal basis for processing so-called browsing data is the Controller's legitimate interest in enabling correct use of the Website's content.
  • Receipt of requests submitted by the user when completing the contact form (the personal data acquired are: first and last name and e-mail address, as well as any specific contents entered in the body of the message). The legal basis for processing the data voluntarily provided by the user is the consent freely given by the user at the end of completing the contact form, if applicable. With reference to such data, it is specified that they are used solely for the purpose of replying to the requests received and are not communicated to third parties. The user is, in fact, the sole owner of their data and may request their modification or deletion at any time: see the section “data subject rights” below. Furthermore, the Controller will not use the data provided for purposes other than those listed above, to which the data subject has agreed.
  • Compliance with legal obligations, or those prescribed by the applicable legislation on Data Protection, and for the assessment of liability by the competent Authorities in the event of alleged computer crimes to the detriment of the Website.

Processing methods

The User's personal data, as identified above, are processed with automated tools by the Controller and by persons authorized to process under its authority, in accordance with the principles of fairness, lawfulness and transparency provided for by the applicable legislation. Specific security measures are observed to prevent data loss, unlawful or incorrect use, and unauthorized access.

Scope of communication and disclosure of data

For the purpose of proper and effective management of processing activities, and in full compliance with the principle of limitation and necessity thereof, Braga Moro does not communicate or disclose the User's personal data to third parties.

The data may be known by:

  • internal staff, duly authorized and instructed by the Controller;
  • parties delegated and/or appointed to carry out technical maintenance activities of the WEB website;
  • parties, natural or legal persons, that provide support services or perform instrumental and/or related activities.

The external professionals/companies that process the above-mentioned data on behalf of Braga Moro have been authorized by the latter or appointed as Data Processors, or identified as independent Data Controllers of the personal data.

It is further noted that the User's data are not transferred outside the EU.

Data retention

So-called browsing data are kept for the time strictly necessary to pursue the purposes indicated in this notice and will be deleted at the end of that period, unless the same data must be retained to comply with legal obligations or to assert a right in court.

With regard to the data voluntarily provided by the data subject, they are retained for the time strictly necessary to handle the requests submitted by the latter to the Controller, provided that it is not necessary to retain them further to defend or assert a right in court or to comply with any further legal obligations or orders from the Authorities.

Data Subject Rights

Data subjects have the right to obtain from the Data Controller, in the applicable cases, the rights set out in Articles 16-21 GDPR (right of rectification, right to be forgotten, right to restriction of processing, right to data portability, right to object). The relevant request is submitted by contacting the Data Controller at the references indicated above.

Data subjects who believe that the processing of personal data relating to them is carried out in breach of the Regulation have the right to lodge a complaint with the Data Protection Authority (www.gpdp.it - www.garanteprivacy.it), as provided for by Article 77 of the Regulation itself, or to bring the matter before the appropriate judicial authorities (Article 79 of the Regulation).
